The "conspiracy"/isolated "madman" aesthetic in these memes makes them hilarious to me. As with all things I am late for this meme and only discovered them through some friends and we ended up making similar sorts of jokes about other things.

I don't know (haven't looked into it in great detail) but I doubt in the example you gave (sex that isn't rape without marriage, and that act only) I would for the general population at least. Can't think of any good reason to do so, not all sins should be crimes to me.

In my opinion it's because in reality they (speaking of "theists" who do this and not others) are naturalists and that's how they operate almost all the time, so there is no reason for them to cease when it comes to God. It is their habit of mind and the permanent disposition of their soul.
