Does the average Muslim believe that Sharia law is inspired by God?

So, there are many things I admire about Islam. I think it is great that you are disciplined, I admire you for staying away from alcohol and drugs for those destroy many lives, I admire your dedication of praying five times a day and the devout manner in which you do, I think also the fasting is very good, and admire the arab style of dress as long as it isn't forced..

I have nothing against the five pillars of Islam.

But there is a behavior that I hate. Cutting off someone's hand or anything that can leave a person permanently disabled, the beating, wipping, caning, and sometimes killing those who drink or gamble, the imprisoning or abusing those who don't abide by a religious dress code, and the persecution of those who have a different belief system. A belief is a belief. You should never be cruel to someone because they have a different belief about something that cannot be proven.

I hate those actions because of the grief they cause others, the bigotry and intolerance they promote, and the misery they bring this world and the lives that are destroyed. Sharia law promotes those atrocious policies.

But Sharia specifically Islamic Jurisprudence is any one of 4 legal systems based upon one of the Madhabs.
There are some differences in the sharia laws depending upon which Madhab is followed.

Basically a Madhab is based upon

Qur'an
Ahadith
Sunnah
General consensus of Scholars
Public Choice
Local tradition
logical reasoning
and
local needs

Many Muftis seem to agree that the Criminal code of Islamic Jurisprudence never fully developed and for that reason most Islamic nations use secular law for the criminal codes

The only Islamic writing that is believed to be the word of God is the Qur'an.
The Qur'an is used as a starting guide in Islamic Jurisprudence. Out side of that the development is very similar to the manner UK and American law developed. some portions of Sharia were adapted into British law most notably those related to banking.

However Sharia is not a single set of laws. There are divisions such as the dealings with Religious manners such as the the correct method to perform wadu.
Then there are the civil laws that cover things like marriage contracts. inheritance, banking laws etc
and criminal laws.
There are also portions governing the basic formats of court procedures, Requirements of defense attorneys, prosecuting attorneys, Judeges, rules of witnesses, requirements to be met to justify probable cause for a trial etc
there are guidelines as to who how and when local and national laws are formulated.
While the laws are man made for the most part the law makers are obligated to verify the laws do not contradict the Qur'an
Needless to say what is sharia does vary by locality and is subject to change to match local needs.

Sharia is quite complex and has very little resemblance to what the media calls Sharia. It can take quite a few years of study just to master a single specialty in one of the Madhabs.
Few nations have any judges or attorneys that are actually qualified in Sharia. One of the few Nations that does have actual Sharia is Israel and it is one of the few nations that have an female Sharia Judge. However she js limited to civil law only and has no jurisdiction for criminal cases.
Currently no nation uses Sharia for criminal cases. Saudi uses the laws of the Monarchy as Saudi is a Kingdom under the jurisdiction of a king. Iran uses Jafa'ari law under the jurisdiction of the ayatollah.

Here are two which seem to have Sharia 'base'.
• A woman cannot drive a car, as it leads to fitnah (upheaval). (Saudi Arabia)
• Meat to be eaten must come from animals that have been sacrificed to Allah - i.e., be Halal. (General)

In England our Laws forbid a lot of Sharia. Here are just some Sharia laws that must be stopped here:- These copied from the www...
• A man can marry an infant girl and consummate the marriage when she is 9 years old.
• Girls' clitoris should be cut (per Muhammad's words in Book 41, Kitab Al-Adab, Hadith 5251).
• A woman can have 1 husband, but a man can have up to 4 wives; Muhammad can have more.
• A man can unilaterally divorce his wife but a woman needs her husband's consent to divorce.
• A man can beat his wife for insubordination.
• Testimonies of four male witnesses are required to prove rape against a woman.
• A woman who has been raped cannot testify in court against her rapist(s).
• A woman's testimony in court, allowed only in property cases, carries half the weight of a man's.
• A female heir inherits half of what a male heir inherits.
• A woman cannot drive a car, as it leads to fitnah (upheaval).
• A woman cannot speak alone to a man who is not her husband or relative.

Saudis prohibition on woman driving is pretty much making them the laughing stock of the Arab world.

The closest thing to driving that can be found in the Sunnah, Ahadith and Qur'an would be the riding of domestic animals. there are numerous references of woman riding horses, donkeys , camels etc by interpolation it can be assumed there is no religious basis to preventing a woman from driving a car.

While Saudi being a sovereign nation has the right to establish any laws it desires including the prohibition of woman driving it should be noted that the laws in saudi are laws of the Manarchy and not religious laws. They are the Rule of the King not the law of Islam although some of Saudi's laws may be compatible with Islam.
What makes the driving law so hilarious is the current war aginst the ISIL the air war is a joint effort of the Arab nations on the Arabian Peninsula under the direction of Saudi
The acknowledged top pilot and the only one with actual combat experience in the F-16 is a 7 year veteran Major Mariam al-Mansouri

The irony here is one of the worlds best combat Pilots can fly a Plane in Saudi, not just any plane but one of the most complex in the world, but after landing she is forbidden to drive a simple automobile

Acknowledgement and thanks is given to Allaah for providing us with the animal to use as food. It is very similar to a Christian saying grace before eating.




I thought there was little consensus on what Sharia means in practice?

There is actually pretty much consensus as to what Shariah is, but no Nation follows the Shariah criminal laws.
what most people think of when they hear Shariah is what they see called sharia by the media.

Sharia is not just crim law....... it is the foundation of civil law as well...... true?

After going through two previous confusing stages before coming down hard on drinkers and gamblers, the Quran finally prohibits alcohol and gambling in Sura 5:90—91; they do not prescribe the punishment of flogging, but the hadith does. A poor 'criminal' was brought to Muhammad who became angry:

The Prophet felt it hard (was angry) and ordered all those who were present in the house, to beat him [the drinker dragged into Muhammad's presence]. (Bukhari, Punishments, nos. 6774—6775)

The Quran says:

5:38 Cut off the hands of thieves, whether they are male or female, as punishment for what they have done—a deterrent from God: God is almighty and wise. 39 But if anyone repents after his wrongdoing and makes amends, God will accept his repentance: God is most forgiving and merciful. (Haleem)

At first glance, verse 39 seems to accept repentance before the thief's hand is cut off. But the hadith states emphatically that repentance is acceptable only after mutilation. Muhammad himself says that even if his own daughter, Fatima, were to steal and then intercede that her hand should not be cut off, he would still have to cut it off (Bukhari, Punishments, no. 6788

Imagine if someone made a list of all of the terrorism and holy wars declared by Christians in the last 50 years compared to Islamic jihads and terrorist acts, and the daily atrocities and injustices committed by harsh Islamic Governments. Enormous difference.

Pathetic false accusations? Just look at what governments that institute Sharia law legally do to people in the name of God. There are textual facts but whether someone provides all the textual facts or not, common sense looks at the world around us and there is more fanaticism, intolerance,religious wars, executions, and terrorism coming from Islam than all the other monotheistic Religions combined. The difference is huge...HUGE Difference! So big it would be pitiful for a Muslim to try to debate that it isn't true.

This gruesome hadith passage reports that a woman was buried up to her chest and stoned to death:

And when he had given command over her and she was put in a hole up to her breast, he ordered the people to stone her. Khalid b. al—Walid came forward with a stone which he threw at her head, and when the blood spurted on his face he cursed her . . . (Muslim no. 4206)

Muhammad's punishment of homosexuals: . . .

'If you find anyone doing as Lot's people did, kill the one who does it, and the one to whom it is done' (Abu Dawud no. 4447).

This hadith passage says that homosexuals should be burned alive or have wall pushed on them:

Ibn Abbas and Abu Huraira reported God's messenger as saying, 'Accursed is he who does what Lot's people did.' In a version . . . on the authority of Ibn Abbas it says that Ali [Muhammad's cousin and son—in—law] had two people burned and that Abu Bakr [Muhammad's chief companion] had a wall thrown down on them. (Mishkat, vol. 1, p. 765, Prescribed Punishments)

The Quran says:

24:2 The fornicatress and the fornicator, flog each of them with a hundred stripes. Let not pity withhold you in their case, in a punishment prescribed by Allah, if you believe in Allah and the Last Day. And let a party of the believers witness their punishment. [This punishment is for unmarried persons guilty of the above crime (illegal sex), but if married persons commit it (illegal sex), the punishment is to stone them to death, according to Allah's law]. (Hilali and Khan).
