I think there needs to be a higher standard for the death penalty than "beyond a reasonable doubt", but I also think that it's ok to put people to death for causing death - somewhat balancing the karma in a single lifetime.

Massachusetts has no death penalty, but this was federal court. The appeal hinged on not allowing the history of criminal behavior of his brother had negative influence on the younger brother, which the judge did not allow to be considered. I think the brother's record ought to have been allowed.

Sad, as two wrongs don't make a right, imo. However, the SCOTUS must go by the law under the Constitution.
