It appears to be just a district court ruling, so it may get appealed.

Other than that, the only other option would be to make it illegal for men to go topless, so that way there would be no discrimination. It would be the same rule for both genders.

I had to check a couple of other web sites to make sure this is legit, and it is, at least for the moment. The city at the center of this (Fort Collins, Colorado) is going to "review the judge's decision. It looks like the city is reluctant to give up on the case."

Their links are odd, but here's a link to another article discussing the ruling. It should also be mentioned that in New York, it is legal for women to walk around topless.
