Copyrights and patents

What are your opinions on copyrights and patents?

Is this a symptom of the nanny state? If you think not, why should the government intervene in this matter and not other matters?

Ought there be a limit regarding what can and cannot be copyrighted or patented?
not much incentive to be creative.....
if a shop well equipped can pump your product faster than you can
the profit you need will disappear as soon as the market is saturated

example.....hand made knives
I made one and sold it at a good profit
then the doors opened to China
the market was flooded with cheap knockoffs of American pocket knives

well.....who wants to spend more for one
when you can have DOZENS of knives for LESS

and they were junk
I bought a couple just to have a good look

THEN having gained the profit margin to upgrade......they did
NOW a China made knife is every bit as good in quality

but I can't even buy material for the cost of buying their product
they upgraded every thing about the product and can buy
material in bulk rates

the door has closed to me
can't get a toe in edgewise

Dear Pharmaceutical Giant,
Over ten years I have researched, developed, tested and proved a new medication which not only stops hair loss but initiates new and full hair growth. A full head of hair can (and has) been achieved from total baldness. Would you be interested in this medication formula? I would seek to be paid 5% on all sales of this product if you manufacture and sell this medication..
Yours faithfully,
Oldbadger

Dear Oldbadger,
We are most interested in your medication formula for initiating full hair growth from total baldness. In the first instance, please could you send all details of your work, findings and most importantly the new formula to us?
If the formula works we would manufacture and market it, but obviously under the 'Curious George' Legislation which has outlawed any kind of patents for any such discoveries we don't think that we should pay you a dime for your years of research or any formulas. Please send your work to us as soon as possible.
Yours sincerely,
Pharmaceutical Giant Corporation.

You're wrong.
Patent protection was devised by Josef Stalin & Josef Mengele (it's a Josef thing) to
foist big government upon us, turning us into a socialist nanny state in order to liberate
the people, & put marketing executives up against the wall when the revolution comes!
No, it's you who's wrong.

The Venetian Patent Statute of March 19, 1474, established in the Republic of Venice the first statutory patent system in Europe, and may be deemed to be the earliest codified patent system in the world.[1][2] The Statute is written in oldVenetian dialect.[1] It provided that patents might be granted for "any newand ingenious device, not previously made", provided it was useful.[3] By and large, these principles still remain the basic principles of patent law.[3]

That's an interesting alternative history.

I haven't bothered to look at many of the other replies so excuse me if this point has already been made.

Patent and copyrights are essential for progress. Without patent and copyright protection, many people would not go ahead with their projects because they would know that everyone was free to capitalize on the inventor's work, and the inventor would never be compensated for it.

I haven't read the entire thread. In case it hasn't been noted: Patent
and copyright laws are governmental methods to stimulate creativity and invention, which seem to be almost universally considered to be beneficial to humans. Indeed, the Industrial Revolution has been attributed in part to the widespread adoption of patent laws.
I think that is true.

It provides benefits to both the society and the individual. It is one of the examples of what can be good about a government, without it being overburdening. It is not perfect and it can be abused, as the case with Disney, but overall, it benefits us all, without being intrusive.

I should qualify that as 'overly' intrusive and unjust.

I think I preferred your other point.

I would suggest that IP is no more big government than environmental law or zoning law. In short, those who bemoan a nanny state are foolish.
