It does not circumvent the Constitutional checks and balances: the courts can void them, and Congress and nullify them and direct the President what it wants her/him/it to do.As for me, I am not a fan of them. They allow the president to make unilateral decisions with circumvents our checks and balances.
The process is of course usually delayed, because it takes time for Congress to respond to almost anything, and it takes time for lawsuits from appropriate plaintiffs to be filed and heard.
