Well MAttt was being investigated for various illegal acts. 8 republicans said they would have voted against him.

I would guess the seat he won in the next Congress that will be seated January 1 is still open to him.
This is exactly correct. Since Congress wasn't seated, he has still not officially lost the seat as a by-election couldn't be called. But if he takes it, that report could be released by three Republican Congress people voting to see it, or any one member of the Republican side of the Ethics Committee. And if the report has new information (which apparently it does) the criminal charges could be reinstated.

I don't know what blog you read that on, but it is nonsense. Gaetz resigned, officially. That means he will not be seated when the new Congress unless he runs in and wins the special election that is going to happen.

Nope. He can't resign unless Congress is seated. CNN is reporting the same thing.

But it’s a complicated question with murky legal precedent. Some lawmakers have already asked the parliamentarian to weigh in and clear up the confusion, one source told CNN.

My mistake, you are correct. He resigned from the 118th Congress, and he cannot under any circumstances be reseated in the 118th Congress. But the 119th Congress is a different matter.

But has already been pointed out, if he does try to sit in the 119th Congress the ethics report is going to come out.

I think everything is going to come out one way or another regardless of what Gaetz does, much of it is already out and more is being leaked all the time.

Gaetz continues to state that he is innocent of all allegations. So I don't know what is in that ethics report. So I don't know. Now that he has withdrawn his nomination as A.G. I am pretty sure Mike Johnson will continue to keep it private. I hope he does. But if Gaetz does take his seat in the new Congress in January, Johnson might have to release it. We'll have to see how it all plays out.

CNN is reporting there are new allegations, which could re-open the criminal investigation. Gaetz might dip out just to avoid prosecution.
