Yes, Kamala Harris cannot run for President. In fact she probably should not be Vice President. How could Democrats have forgotten that the Dred Scott decision means that she is not a "natural born citizen". Or at least that is what a Republican group is claiming:


The National Federation of Republican Assemblies (NFRA) has cited the infamous 1857 Dred Scott Supreme Court decision, which stated that enslaved people weren’t citizens, to argue that Vice President Kamala Harris is ineligible to run for president according to the Constitution.



“An originalist and strict constructionist understanding of the Constitution in the Scalia and Thomas tradition, as well as precedent-setting U.S. Supreme Court cases ... have found that a ‘Natural Born Citizen’ is defined as a person born on American soil of parents who are both citizens of the United States at the time of the child’s birth,” the document states.


The group then cites six cases including Dred Scott v Sandford. The 1857 ruling came a few years before the 1861 outbreak of the US Civil War over the issue of slavery, stating that enslaved people could not be citizens, meaning that they couldn’t expect to receive any protection from the courts or the federal government. The ruling also said that Congress did not have the power to ban slavery from a federal territory.

Correct me if I am wrong, but wasn't the Constitution amended some time after the decision?

I have been saying this for almost 200 years, ever since Andrew Jackson got elected. He was not eligible to be President because his parents were born in Ireland.

But the question that I am not sure of is this. Do both parents need to be born in the U.S., or just one? Because if we can disqualify people who have only one foreign born parent then we can disqualify a whole bunch more. We can disqualify Thomas Jefferson, James Buchanan, Chester A. Arthur, Woodrow Wilson, Herbert Hoover, Barack Obama, and of course, Donald J. Trump.

Let's disqualify all these bums!

I had not heard of this group but found a short article on Wikipedia about them:


The first Republican Assembly was founded in 1934 in California. The Republican Assembly movement grew primarily in the western part of the United States until, in 1996, the several state Republican Assemblies formalized their relationship to one another through the creation of the NFRA, which was also tasked with the establishment of state chapters in those parts of the country to which the movement had not yet spread.[citation needed]

In 2012, the NFRA's Presidential Preference Convention endorsed Rick Santorum for president on the fifth ballot.[1] In 2016, it endorsed Senator Ted Cruz.[2] In 2020, the NFRA endorsed Donald Trump. In 2024, the NFRA endorsed Donald Trump.[citation needed]

The group were criticized and accused of racism for citing Dred Scott v. Sandford., which ruled that people of African descent (African-Americans) didn't have the same rights as white citizens, as a reason for Kamala Harris' ineligibilty of becoming the President of the United States. [7]

The organization also adopted a "right of return" policy goal that would encourage and subsidize "the voluntary emigration for any citizen of the U.S. who wishes to emigrate to their country of origin/ancestry provided that their ancestors were brought to this country against their will". The policy which drew comparisons to the attempted ethnic removal of African-Americans by the American Colonization Society was criticized. [8]

Good grief. It sounds like getting an endorsement from this group would be like getting an endorsement from the KKK.

Actually the Bahamas were British before it became independent. But unlike many European and Asian countries in the US citizenship is by birth. That is how some people can have dual citizenship here. I had a college friend that was American and German. His father had actually been in the SS. His father was not a fan of Hogan's Heroes for some odd reason.
