From what I see on less biased news outlets, the counting these votes is still subject to a legal decision regarding the constitutionality of the law that says they can't be counted. They have a lower court decision that allows counting them and a stay of execution from the (State) Supreme Court.

So, it will all be settled legally, we just have to wait. In the meantime, I don't see why they can't be counted, so long as a separate total is maintained.

Well, at least they are sticking to the tactics Republicans have already played that doesn't involve fake electors and rioting at the Capitol. From your Fox article:

Democrats have defended their actions and pointed out that McCormick himself had argued to count contested ballots when he trailed celebrity heart surgeon Dr. Mehmet Oz in the 2022 Republican primary for U.S. Senate.
