Punishment: men vs. women.

What is you stance in this subject?

Hello guys.

What do you think of punishing men and women, for the same violation deserving of punishment, based on their gender? For the sake of discussion, let's discuss a line a heard in an anime just now; "he's going easy on you. If you were a man, he would have rearranged you face". The setting was a cadet female soldier disobeying a direct order causing trouble and getting slapped for it by the leader. What do you think of this saying and what the woman got?

I personally agree with the outcome and think women should receive lenient punishment than what their actions deserve than men for the same mistake, if it has a punishment, of course.

As for the poll, physicality is a heavy part of it to consider when voting.

It's a tough question.. I do think that as both men and women are of equal intelligence and capacity of thought, there are certain crimes which should be punished equally. Things like fraud, troublemaking etc.

I do think that physical punishment is out of the question, unless perhaps carried out by another woman.

Good point having a women applying what has to be done to women. I noticed that airports and police stations worldwide don't seriously consider this in personal searching, which bothers me. I think this is related to our discussion here too. I'm all for providing women to handle physical tasks with women for searching.

As for punishment, if my brother does something wrong and gets it, I kinda feel that he can take it, but for a sister, I can't feel the same. Let's say my brother causes trouble having a fight and gets punched in the face for it, I would think that he brought it upon himself and that he should live with it. That feeling is different with a sister.

Maybe equality in this context can actually be sexist? Let say having the exact same dressing code for both genders; I think that would be unjust towards women if, just as one example, this equality in dressing code would exclude appropriate wear peaces women normally need that men don't. I know at least many women would complain at shirts tight in the upper part of the body and think it hurts their gender.

Yeah the searching thing can be troublesome. Each to their own some women don't mind it, but I'm sure there's plenty that do mind.

Punishments should be equal.
Physical retaliation (to being attacked) should be determined by the the attacker's weight, size, durability and threat level.

There should be similar punishments for theft, embezzlement, violence and cruelty, however a judge sometimes ought take into consideration the person's situation. For example a woman sentenced to death may be pregnant. Fines are another punishment that may require adjustments according to how wealthy the defendant is. The idea of a fine is that its a flat fee, but there is no such thing as a flat fee in today's economy. We do not live in a world of unchanging prices for things. 50$ worth of goods today might be equal to 2$ worth of goods in 1959, and income levels have skewed wildly. Some people are untouched by a 10,000$ fine, because its so small relative to their income. What about dependents and spouses who stay at home to take care of the kids and don't work? If you fine them they can't pay, so how can you make a fine equal? How can a jail sentence be equal?

That's what I would like to know the what the readers' opinion in is. It all started with that line I heard in the anime and on a whim my opinion I mentioned on the OP came to be.

I thought that way, however, because I believe women are less tolerant to punishment, especially physically, than men. I believe women are kinder at heart that they mentally take it harder than men, right next to physically normally. All that was also based on my heart, rather than my head, so I think this is a factor too. But let's be real, we do have hearts, right?

Um, do I get it that do you guys who voted the first option have no special compassion for women vs. men? Please correct me if I'm wrong, but that's what I understand from it.

I used to think women were kinder, but I think that is not true in general. We men tend to associate all women with our mothers, and that can skew our view of women. I think they favor people they are in relationships with more than men do. I also think they are often not aware of doing so as much as men notice ourselves doing it. There are other differences that make them seem kinder when really they are just different. They are physically weaker, so that makes them seem kinder, too. It certainly makes them think twice about impolite behavior.

the circumstanced of the person is always taken into account but as we do not have the death penalty that does not apply.
The sentence can be very different depending on those circumstances. very few sentences are mandatory.

Scandinavian countries have fines based on how much you make. Here in Finland you can be pay fifteen days fine for example. Some poor people can get a few hundred euros fine where a rich businessman can get hundred thousand fine.

Corporal punishment should be banned. So with the physical element removed, it should be equal.

This. What confuses me about this thread is the word "punishment." Punishment to me means some sort of official sanction, like a jail sentence for a crime or a kid having to stay in at recess. In my eyes there shouldn't be anything physical associated with official punishment like that at all to either gender.

But then in Smart Guy's example he talks about punching someone. In a case like that I definitely would treat a man differently from a woman. I'd punch a guy for calling my wife a bi*ch, but I wouldn't punch a woman for it.
