Judge Finds Colorado Sex Offender Registry Unconstitutional

Interesting & compelling argument by the judge.
Thoughts?

I don't support vigilantes or mob justice, so I would have to agree that creating a searchable public data base with names, pictures and addresses is a breach of the rights of criminals. Nor is the principle of turning citizens into informers who watch convicted criminals conducive to a free society. Its the practice of a police state.

In some states you could be classified as a sex offender if you are 18 and caught having consensual sex with your 17 year-old girlfriend the night before she turns 18. Although I have no love for true sex offenders, I do believe there is some gray area.

Apparently drunkenly urinating in an alley could land you on the registry, too. While unacceptable behavior, it doesn't belong anywhere near, much less in, the same basket as child rape.

Good point.Its not a one size fits all solution. A person like you used as an example should not be classified the same as a child molester or rapist.

Except in the case you presented, the 18 is not a sex offender.

No one has even implied that the register being unconstitutional would make pedophilia legal.
That is one huge leap off the deep end.
