I agree with you. There's not much reason to continue punishing someone. You're asking them to just commit crime again, because you're taking away all their legitimate options.
Though thinking about it, even without giving companies access to criminal records, will still be awkward in the interview when they say "There's a five year gap here in your CV where you are unemployed... Care to expand on that?"

"Umm... professional development and self-improvement?"

Still better than nothing though I suppose. They'd still have the opportunity of impressing at interview rather than being rejected before that.
