Smoker's Rights vs. Everyone Else's Rights

And yet we arrest people who smoke non-addictive alternatives to the hybrid tobacco crap put out on the market nowadays. The law here is seriously messed up.

If you do settle, apparently you will be castigated to your own private property, which must a contain a closet approximately 4 x 4 foot with no windows or possible way for smoke to escape. There just isn't enough space for all the non-smokers to practice their rights of incredibly dirty air minus the cigarette smoke, I guess.
