For instance, here's what constitutes workplace harassment under the law where I live:

Engaging in a course of vexatious comment or conduct against a worker in a workplace that is known or ought reasonably to be known to be unwelcome.

It would be possible for these statements to constitute harassment, especially if they're repeated. I see no need to carve out a special exemption to the normal law that applies to everyone to make it easier for bigots to be jerks to trans and NB people at work.

you seem to think that saying stupid things is somehow illegal or potentially illegal. Free speech does have it's limits and there is a small class of things it is illegal to say, (slander, incitement of violence) but stupidity is not one of them.
