The point is, that all jobs have inherrent risk. If I want to work in a mine, I get compensated well, knowing one day I will probably have respitory problems. These are factors in the workplace. It doesnt matter what the "competing motivations" are because IT IS NOT THE GOVERNMENTS RESPONSIBILITY TO FIND YOU A JOB YOU FEEL COMFORTABLE WITH! If you dont like where you work go work somewhere else, or start your own business.

Geez! You started the thread about smoking in public places and now you think you win that argument by yelling "IT IS NOT THE GOVERNMENTS RESPONSIBILITY TO FIND YOU A JOB YOU FEEL COMFORTABLE WITH!". Pray tell, how is this connected to the government's interst in worker's and the public's health?

Because numerous jobs have health and safety risks if you dont like them find a different job, dont come up with overbearing legislation. You still have not answered my question....Where do you draw the line? There are many jobs that pose much more risk to health than a server being around second hand smoke, when are we going to start outlawing other jobs that are even riskier?

If smoking was completely banned I would agree, but we are talking about banning a legal activity in a private establishment, and I think that constitutionally there could be problems with that.

Businesses should have a right to choose if their establishment is to be non smoking or not. People can choose whether or not to visit or even work there. Here in Japan a majority of the population smokes, and there are rarely non smoking sections, even in office buildings. Yet, they have a longer life span because they generally eat healthy and get more exersise. Fast food is unhealthy so is lack of exercise. It can cause heart deisease and diabeties. Why not ban fast food and make everyone fide bikes while you're at it?

So can we assume that the good people of Colorado are concerned about the health of people who frequent or work in bars and restaurants, but not the health of people of frequent or work in casinos?

I agree that people shouldn't have to suffer for other people's bad habits, and I assume the state of Colorado is also providing all citizens with plastic bubbles to protect them from auto exhaust and other pollutants.

Would the casinos be on tribal land? If so, what does the law say about the relationship of tribal law to state law? Is the federal law dispositive?

I don't understand your agreement juxtaposed with your sarcasm. What's your point?

Some casinos in Colorado are on tribal land, and some aren't. The bill allows smoking in licensed casinos without reference to whether they are on tribal land or not. A PDF image of the bill is here.

My point is that there are bigger threats to public health than second-hand smoke. I also think the right to access to public accomodations should not include the right to force those accomodations to conform to your preferences.

You are correct when you say that I did not take the job because it was smoking. If I was given a choice between working in a smoking or non-smoking enviroment (bar or restraunt mind you) I would choose the SMOKING establishment each and everytime (assuming that all other variables are equal). Smokers are much better tippers for one thing! That is not based on any scientific study, just my own observation.

I find it interesting that Colorado has banned smoking in public places while Denver has decriminalized the possesion of marijuana. I'm so confused by all these mixed signals....

Many studies have been done claiming that allowing G&L marriage or adoption may cause real damage to societal health and well being. These studies are just as bogus as those conducted on second hand smoke. Both are just meant as scare tactics for one group to get their way through fear and intimidation.
You would take the time to read the rebuttals against gay marriage ban, so take the time to read those exposing second hand smoke myths.
I will post them shortly.
