While Biden is still in office, and Trump is threatening to prosecute his perceived enemies, who should Biden pardon?

While he is still the sitting president, Biden could issue preemptive pardons for individuals he believes might face prosecution in the future.

U.S. presidents have broad pardoning power under Article II, Section 2 of the Constitution, which allows them to grant pardons for federal offenses. This power has been interpreted to include the ability to issue pardons even before formal charges or convictions.

So Biden could offer Pardons to protect D.A.'s and Judges who have angered Trump. He could Pardon Democratic member's of Congress. He could even pardon member's of the media.

I think that right now, Biden should be issuing preemptive pardons for anyone that Trump has ever threatened, criticized, called the "enemy of the people" etc.


So who do you think Biden should pardon before he leaves office?

Can he? I don't think that is how pardons work. They are not pre-emptive. You have to be convicted or at least prosecuted for a crime.

If he can jump over his shadow (and embarrass Obama), he could pardon Snowdon and other whistleblowers.

I would say Hunter. That was a case of pure lawfare. A reasonable plea bargain had been worked out. If anything it was a bit stiffer punishment than what other first time offenders would have received. But that was not good enough for the Republicans.
