Prop H8 mostly upheld

The California Supreme Court upheld Proposition 8 today, meaning same-sex marriage will remain banned in California. However, the Court also declared that the 18,000 same-sex marriages legally entered into last year must be recognized.

The ruling was exactly as expected, and gives the victory to the Mormon, Catholic, and Evangelical churches. You'll have to excuse me if I don't congratulate you guys.

The one on the left, over Brigham Young’s signature is the “Mormon Creed.” Did you know we had a creed? No? Well now you do. This scroll says, “Mormon Creed: Mind you own business.”
Too bad that creed is long forgotten.

You don’t get much more to the point that that. Probably the only person who could have said it even better would have been J. Golden Kimball. He would have probably inserted one other word in between “own” and “business.”
So would I.

As a Californian (and long-dormant member of these forums), I must apologize for our state's voters and, recently, our supreme court. Today will go down in history as the day when a religious value became more important than civil rights. Although there have certainly been precedents elsewhere, this decision puts one of the final nails in the coffin that is the very tenuous separation between church and state.

It does indeed suck. However, the recent conversion of several other states is very encouraging and it will only be a matter of time before California follows. It just sucks that it's taking so long.

Today's ruling was on a narrow question of California constitutional law. In the long run, California will approve same-sex marriage through legislation or Constitutional amendment, which will be for the best. Gay rights are advancing at lightning speed. Rather than be discourage, we should begin work on the process of persuading California voters to amend their Constitution to permit same-sex marriage.

It's kind of interesting that there will remain 36,000 same-sex married people in California. I'm thinking they will turn out to be key in overturning this policy--in the long run.

This is just an inevitable bump in the road. All civil rights movements have them. And like other civil rights movements, the results of this one are inevitable. It will just take a little more time.

Though I doubt SCOTUS will ever tackle prop. 8 and see it as violating federal law in any capacity, nor will there ever be 5 votes on the court who'd overturn it, the fight is far from over. I predict another amendment on the ballot come 2010 will repeal the decision. But still, what a legally predictable yet insulting decision this is.

So I expect November 2010 may be the turning point.

It's not really news since we all knew what the decision would likely be. As the court said, proponents of gay marriage need to pass their own voter initiative (unfortunately, that's the crappy system we have in California).

Civil rights? Gays have the same rights as straight people. As far as I can tell, California law says nothing about love being a requirement for marriage. A straight woman has the right to marry a man, and a lesbian has the exact same right. A straight man has the right to marry a woman, and a gay man has the exact same right.

I always wonder if people who make this argument are stupid, or just being deliberately mean, or just didn't stop to think before posting. Think really hard, Weddy, would you be satisfied with the equivalent right? Would the right to marry a person of the same sex be satisfying to you?

(Why is it that I constantly have to remind Christians how to practice the Golden rule? It's like teaching moral kindergarten with you Christians sometimes.)

They wouldn't get "special" treatment. If same sex marriage is made legal, you'll have as much a right to marry another woman as any lesbian.
