Rape?

Apparently, a Palestinian man had sexual intercourse w/ an Israeli Jewish woman. He claimed to be Jewish however so he could... You know. The Israeli court claims it to be rape and charges him w/ it because they had sex under a false pretext (or whatever you would call it).

As if a sexual act ever could be considered rape when both partners are adults and act consensually. :facepalm:

It's not rape if it was consensual. Just because he lied about being Jewish that doesn't make it rape.
If he's going to get charged for that then they need to charge all the guys who said they put on a condom when they didn't, and all the girls who said they were on birth control when they weren't.

As far as I know its the same judge who already had provocative verdicts in other trials which got public attention, so before people scream racism by the system they should ponder the idea of poor preformance by a specific judge.
consider that this judge also sentenced a female art student for 2 years in prison for dawing a caricature portraying the Prophet Muhammad as a pig and hanging the caricature on Arab shops.

Consensual sex is not the same thing as rape, I mean they guy did what he had to do to get into the girls pants...at least it was consensual sex.

Sometimes judges do things to look good in the eyes of the public or maybe they have a vendetta against certain types. Just my two cents...not much of a debater, but I wanted to respond to this thread.

The only instances where I think the law should intervene in a case of "consensual fraud" is when one of the partners knowingly lies about having an STD or (perhaps... still thinking about this one) being on birth control.

My only problem with this is that I personally feel that it is the responsibility of both parties to take precautions regarding the consequences of intercourse, not just the female partner (assuming straight sex). Accepting one's partner's word that "I'm on the pill" without any means of confirmation, and knowing that the pill is not 100% effective, and that the pill can be and is prescribed for reasons other than strictly birth control, shouldn't be an excuse to get out of one's responsibility.

If one does not intend to impregnate one's partner one should ensure that all reasonable precautions preventing such are taken. Just because one enjoys the sensation of not wearing a condom, does not excuse one from the consequences of one's actions should other means of birthcontrol fail. Put it on before you put it in.
