Supreme Court to Decide Whether to Kick Trump Off Ballot

"The legal debate about whether or not former President Donald Trump should be allowed to appear on the 2024 ballot has made its way before the Supreme Court.

The court distributed John Castro v. Donald Trump to the justices for conference on Wednesday ahead of the upcoming term, which will begin on October 2. Conference is to take place on September 26 and the case is expected to be decided on or before October 9.
Castro, a tax attorney running for the Republican nomination next year, sent his petition to the Supreme Court last month, asking the justices to answer whether political candidates can challenge the eligibility of another candidate of the same party running for the same nomination "based on a political competitive injury in the form a diminution of votes.

The lawsuit is seeking to argue that Trump should not be allowed to run for the White House based on section three of the 14th Amendment, which disqualifies individuals from holding public office if they have "engaged in insurrection or rebellion" against the United States. While Trump has not been charged with insurrection, Castro is pointing to Trump's role in the January 6 Capitol riot."

Here is something curious. Trump haters spout that he is so unpopular. Yet they are maniacally attempting to keep him off the ballot. If they truly think he isn't popular they should welcome having him on the ballot so he would lose.

The law is the law. It should be blind. It should be enforced regardless of what a political party wants or does not want.

I'd like to see Donald Trump disqualified from contending for the presidency and re-election. This is not because I dislike him, but because I believe he incited hundreds of his MAGA supporters to violence in order to prevent Congress from officially declaring Joe Biden the next president. I believe that he continues to support them and their violent uprising at the U.S. Capitol. In addition to these two reasons, I think that he is exceedingly corrupt and also potentially guilty of multiple felonies, for which he is deserving of imprisonment. Lastly, I believe that he purposely tries to undermine our democracy by continuing to spread the lie that the 2020 presidential election was stolen from him. I think he is capable of much worse in his attempts to retain power.

It varies from State to State. But to pick one State completely at random (;)), in Florida felons can vote, but only after they have served their sentence.
In Kentucky, after serving their sentence (time served with probation/parole complete), they may vote as long as their offense was nonviolent, not treasonous/seditious/insurrectionary or a sexual offense.

Of course not, just as it should not be forfeited because of animus towards populism or DJT. And many, many of those attempting to keep Trump off the ballot care more for their hatred than they do about any Rule of Law.

The Law

14th Amendment, Section 3:

the Disqualification Clause, bars any person from holding federal or state office who took an “oath…to support the Constitution of the United States” and then has “engaged in insurrection or rebellion against the same, or given aid or comfort to the enemies thereof.”

And since an active court case involving such will continue to drag on, likely well after the next major national election, we may need to favor that clause.
