That could be the best possible outcome.
When courts accept, on the basis of McConnell's comment, that Trump wasn't acquitted but the Senate declared itself as not competent, then a thorough investigation* can be conducted and Trump be indicted before a real court. If that happens, Trump will wish he'd have been convicted by the Senate.

*We know that the storm on the Capitol was well planned. We don't yet know how much Trump or other high-ranking GOP members were involved in or informed about that planning.
And if Trump had not riled up his sheeple and promised to march with them to the Capitol then planned or not it would not have happened. The huge crowd of useful idiots, and this time the phrase is spot on,was needed for the planned insurrection to have any success at all.

And it is pathetic that after years of complaining about widespread voter fraud and it being so easy to do, Republicans had their big day to prove it. They didn't, they fell flat on their faces, and still believe in widespread fraud.:facepalm:

Yes, it all came miraculously together - not. Someone knew something.
And I guess a real court may want to look into that and even if there is nothing to connect Trump to, a court may have a different view on allowed free speech than some Senators.
It now all comes down if a court will take the case. If Trump was acquitted by the Senate, he can't be tried again for the same crime. (Though he may face charges if there is evidence for conspiracy.) If the Senate declared itself not competent the way to the courts is free. It will come down to interpretation.

That wasn't a criminal court so I'm not sure if double jeopardy applies.

But, the Senate voted 56-44 not to adopt the Trump team’s arguments.
And then, as did McConnell, went on to say, basically, "well, yes, the Trump team proved their case, but there was this jurisdictional issue," an issue most legal minds deem to be false. They did it for their own benefit, not the nation's -- just as you would expect.

Give me a Liz Cheney or Mitt Romney any day of the week, who do the right thing, even though it might cost them personally.

People are complaining about partisanship as though
it's out of the ordinary. Did they complain about it
when Bill Clinton wasn't convicted? The Constituiton
was designed to make impeachment trials partisan
by conducting them in the Senate.

Caution:
I'm not saying the system should be this way.
It just is. And tis useless to expect otherwise.

Since Republicans split that shows they couldn’t have voted as partisan. The fact that all Democrats voted the same way means they are partisan.
It depends on who was right, and the vote was overwhelming that trump incited insurrection and insurrectionists wanted to kill Nancy Pelosi and Mike pence.

In retrospect, Nixon was quite foolish to have an electronic taping system in the White House anyway. They found the "smoking gun" which was evidence to convict him - and there was no spinning it away or leaving it open to interpretation. Even staunch Republican supporters like Goldwater knew it was all over, which is when he visited the White House, and Nixon resigned shortly thereafter.
