Even though ostriches never did this since it was claimed that they did so at one time it is called the "Ostrich defense". But in reality only people could come up with something so silly.

It is always legitimate to ask for the evidence of something. But once given the evidence you would have the burden of proof to refute it. That can be nigh impossible for a non-scholar. At any rate trying to claim that others are saying that it "just happened" is false.

No. No magic needed. Is gravity "magic"? Is a snowflake? Or a burning fire? Evolution can be understood in the same way that those concepts are understood. No magic needed. In fact it can be shown that evolution is inevitable.
