Qualified immunity for homeowners.Easy one. The homeowner would get off Scot free.
the answer you were given is accurate if it had happened in my neck of the woods....Depends.
1. What state it was in.
2. Was the person in the house.
3. Were you in life threatening danger.
4. Did you warn them.
5. Were they outside the window and turned to run and were shot in the back.
6. etc
The courts and lawyers would dipict many things.

Then it appears your hypothetical was far to generalized to be worth much, right? Not everyone lives in your neck of the woods.
In my neck of the woods there are plenty of old wells that.....
Was it? Do you know what their neck of the woods is like or just base everything off your neck of the woods? .Then it appears your hypothetical was far to generalized to be worth much, right?
You left out a long list of details. Was it? Do you know what their neck of the woods is like or just base everything off your neck of the woods? .
You'd rather the police officer had the measure of justice with his trigger finger?I have just been scanning US supreme court rulings
it seems the practice of stopping a fleeing suspect has been......tethered
so......we may all well expect...
the burglar that just ran out from your house.....is free to go
yes he is
Aye, tis self preservation mode.but you would be politically correct
and not likely to stand trial
I would be anyway. At least you wouldn't be accused of being a racist cop.
Involuntary manslaughterIt's still negligent homicide at best.
Only if she was following proper procedures.Involuntary manslaughter
From what I saw she was.Only if she was following proper procedures.
It's a poor excuse for a twenty something veteran of the force. From what I saw she was.
Other than drawing her sidearm instead of her tazer...
Officer who shot Daunte Wright dead during traffic stop has resigned, mayor says
If she had her taser on the same side of her body as her firearm she could get in trouble.I guess that would depend if she follows police guidelines and procedures. If not, I see it as negligent. At least from a non lawyer layman's view.
It is time to stop digging.Depends.
1. What state it was in.
2. Was the person in the house.

4. Did you warn them.

That's something I had in mind when posting. If she had her taser on the same side of her body as her firearm she could get in trouble.
This was pretty major. But we are of course discussing this from a legal point of view.As my driving instructor once said: "There are no accidents, only minor and major ****-ups."
It depends upon the prosecutor.Easy one. The homeowner would get off Scot free.
