Yes, their job is to interpret, not just function as a robot, that is why we have this structure, the law is not an air hockey table.

On the surface, it makes sense to give immunity
for official acts, & no immunity for personal acts.
Although, absolute immunity is a bit much.
Qualified immunity for official acts would be better.

The whole concept of immunity was made from
whole cloth by SCOTUS. So something that exists
independently of the Constitution is more easily
modified / granted / revoked / expanded by fiat.
