Yet doing so is not legal when dealing with a no-fault divorce. The truth is that such is the case. And while facts of affairs are not relevant to the law, these facts still slip in regularly. What does this show? It shows that judges are human and can not always be completely impartial. The same is true regarding the presumptions of w9men as better caregivers.My brother was also awarded child custody on the basis of these ordinary reasons. I should have also noted that judges often look unfavorably on a party who has had an affair that breaks up a marriage.
While there are many judges that do not have this belief or do not take this belief into consideration it can and does still happen.
I would be comfortable enough to say that gender is unlikely to play a role in custody, but not comfortable enough to say that gender would not play a role.
I would say that the same applies to other discretionary matters such as alimony.
