The other is the determination of the sentence. Just as it is wrong to presume guilt it is also wrong to presume the appropriate sentence.

Both parties have decried the ersatz criminality of the other party. I don't recall you protesting when Democrats called various supposed Republicans criminals. Except with this Trump is on record advocating overthrowing a federal election, sowing distrust and doubt over the election, and stoking fears in front of an angry mob that he was inciting. We also have his reactions during and after.
