Proving abuse in that case is complicated. If she is injured (taken as physical evidence of not consenting) and presses charges, he may face jail time. Otherwise, the investigation itself is nuisance but jail time is unlikely. rape is not easy to prove, and proof is necessary in order to convict. Better just to kick him in the junk as hard as possible and leave before things get out of hand.

Because people so inclined will use their holy texts to support their beliefs rather than to review those beliefs.

It is not peculiar to Islam; it is simply a case where sexists examine their sacred texts, the histories, laws, parables etc with the intention of trying to find something that supports their sexism, racists to support their racism and so forth... there is no great mystery why such behavior and attitudes persist despite religious philosophies. Seek and you will find - some excuse for what you wanted to do anyway.
